Terms and Conditions:

1. Auction will be held regardless of weather conditions.

2. All consignments must be checked in and tagged immediately upon arrival. No Day of Auction Consignments.

3. Consignors must supply a State Issued ID with Name, Address and Phone number. Also, must provide description of the items being consigned. All Consignors must sign a Consignment Control Form (Contract), which gives the right to sell all said property – having good title and free from all encumbrances. 

4. Loader equipment will be available to unload and load consignments. Items MUST be removed from the location within 3 days after the conclusion of the auction. Auctioneers and Staff are not responsible for damaged, lost, or stolen items. Auctioneers or Staff shall have items removed.

5. CONSIGNMENT RATES:

No one item may exceed a commission rate price of $2,500.00.

Consignment Rates are charged per Consignor, NOT per item. Items not sold will be charged $30 per item (This includes all Farm Machinery and Miscellaneous) ALL TITLED items not sold will be Charged $100 per item. 

6. Auctioneers or Staff, Reserve the right to settle ALL transactions, especially consignments that are NOT represented correctly or honestly.

7. Auctioneers and Staff are NOT responsible for accidents, damaged/lost/stolen items. Items are yours as soon as they are sold.

8. Settlements checks will be mailed within 10-15 days following the Auction. Auctioneers will aid in collecting bad checks if that situation arises. A $100 bad check fee will be accessed if this situation arises. If settlements DOES NOT amount to $25.00 or above, no payment will be sent out and a portion of those commissions will be donated to a local charity deemed at the conclusion of the auction. 

9. Auctioneers are bonded (Auction Recovery Fund 4707.25) and licensed in favor of the State of Ohio, Ohio Department of Agriculture.

10. Absentee bidders are required to register their Name, Address, Phone Number and State Issued ID and MUST state their bid in writing. 

11. Item(s) consigned will be sold  either as Reserve or an Absolute type of sale, RESERVE – meaning: an auction in which the seller or agent of the seller, reserves the right to establish a stated minimum bid, the right to accept or reject any or all bids, or the right to withdraw the property prior to the completion of the auction by the auctioneer. ABSOLUTE – meaning: (a) property is sold to the highest bidder without reserve (b) does not require a minimum bid (c) does not require competing bids of any type by seller or agent of seller (d) does not require withdraw of property from the auction after auction is opened and public solicitation of bids.

12. ONLY FARM RELATED ITEMS are permitted at the auction. The following WILL NOT BE ACCEPTED:

    1. NO Car, Equipment, Tractor, Truck or Semi TIRES of any kind

    2. NO HOUSEHOLD ITEMS (This includes the following – Doors, Windows, Sinks, Tubs, Hot Tubs, Cupboards, Glass, Mirrors, Stoves, Refrigerator, Washer, Dryer ETC.)

    3. NO TRUCK CAPS or BEDLINERS, SEMI Hoods or Scoops

    4. NO BOAT’s, CAMPER’s, CAR’s, VAN’s or SUV’s 

    5. Items not deemed marketable will be rejected, if left, those items will be charged a dumping fee at the discretion of the auction staff. 

    6. Exception to the above – Any consignments made by the State of Ohio, Any County or Township items will be accepted. Also, Exceptions will be made for ESTATE’s or whole FARM Auctions.

13. Items left after the auction or that did not sell the day of the auction may include a dumping fee if Auctioneers or Staff need to dispose of.
